در این مقاله سعی داریم تا با یکی از عقود مهم در قانون مدنی ایران یعنی وقف آشنا شویم. همچنین به بررسی مباحث پیرامون آن مانند ارکان آن و رجوع از آن بپردازیم.

عقدوقف
وقف در لغت یعنی حبس کردن است. در همین راستا ماده ی ۵۵ قانون مدنی به تعریف عقدوقف پرداخته است. طبق این ماده:
«وقف عبارت است از اینکه عین مال حبس و منافع آن تسبیل شود.»
عقدی است لازم بدین مفهوم که پس از حصول شرایط آن (یعنی ایجاب، قبول و قبض) قابل فسخ نیست. لازم به ذکر است که عقدوقف از عقود عینی است. یعنی علاوه بر ایجاب و قبول نیاز به قبض توسط موقوف علیهم دارد.
برای آشنایی بیشتر با مفاهیم آن باید موارد زیر را بدانید:
واقف
شخصی که مالش را در راستای استفاده خیر وقف کند. این شخص برای انعقاد عقدوقف باید دارای اهلیت باشد. یعنی بالغ، عاقل و مختار باشد و حق تصرف در مال خود را داشته باشد. از سوی دیگر بنابر ماده ۵۷ قانون مدنی واقف باید مالک مال وقفی باشد.
موقوف علیهم
موقوف علیه شخص ذی نفع میباشد یعنی منافع مال موقوفی به نفع او بخشیده شده است. اگر موقوف علیه اشخاص متعددی باشند در آن صورت موقوف علیهم نامیده میشوند. شرایط موقوف علیه با موقوف علیهم عبارت است از:
- موقوف علیهم حین عقدوقف موجود باشند
- موقوف علیهم معین باشند
- اهلیت تملک را داشته باشند
عین موقوفه
عین موقوفه همان مال موردوقف است که توسط واقف به موقوف علیه تحویل داده می شود. حال این عین موقوفه باید برای اینکه به عقدوقف برسد شرایطی داشته باشد که این شرایط عبارتند از:
- قابلیت عین بقا یعنی بتوان در دراز مدت از آن مال استفاده کرد بدون اینکه بواسطه استفاده از آن مال از بین برود یا خراب شود. بنابر ماده ۵۸ قانون مدنی ایران فقط وقف مالی جائز است که بابقاءعین بتوان ازآن منتفع شد اعم ازاینکه منقول باشد یا غیرمنقول مشاع باشد یا مفروض.
- مال موقوقه قابلیت تحویل و یا همان قبض را داشته باشد. زیرا مالی که نتوان آن را به قبض داد را نمیتوان وقف کرد. بنابر ماده ۵۹ قانون مدنی، اگر واقف، عین موقوفه را به تصرف درنیاورد، وقف محقق نمیشود و هر وقت به قبض داد، این عقد تحقق پیدا میکند.
انواع وقف
دو نوع است: وقف عام و وقف خاص
وقف عام
جهت امور عام اعم از مسجد و مدرسه و بر فقرا و بر ایتام و غیره انجام میشود.
وقف خاص
بر اشخاص معین انجام می شود مانند: وقف بر فزرند.
رجوع از وقف
همانطور که ذکر شد وقف از عقود عینی است. یعنی علاوه بر ایجاب و قبول نیاز به عنصر سومی یعنی قبض دارد. تا زمانیکه واقف مال موقوف را به قبض نداده امکان رجوع از آن برای او متصور است و میتواند از آن رجوع کند. ماده ۶۱ قانون مدنی در مورد رجوع از قبض بیان داشته است :
“وقف بعد از وقوع آن به نحوصحت وحصول قبض الزم است و واقف نمی تواند از آن رجوع کند یا درآن تغییری بدهد یا ازموقوف علیهم کسی راخارج کند یا کسی را داخل درموقوف علیهم نماید یا با آنها شریک کند یا اگر در ضمن عقد متولی معین نکرده بعدازآن متولی قراردهد یاخود بعنوان تولیت دخالت کند.”
پس با توجه به ماده مذکور تا زمانیکه مال موقوفه به قبض نرسیده امکان رجوع از آن متصور است.
از سوی دیگر بر اساس ماده ۶۰ قانون مدنی:
”در قبض، فوریت شرط نیست بلکه مادامی که واقف رجوع از وقف نکرده است هر وقت قبض بدهد وقف تمام می شود.”
