همواره در زندگی مشترک، زوج و زوجه از حقوقی مشخص و معین برخوردار اند و تکالیفی را باید در راستای علقه ازدواج خود عهده دار شوند، در مباحث قبلی به موضوع نفقه زوجه پرداخته شد و این موضوع مورد بررسی قرار گرفت.
حال در این بلاگ سعی داریم تا موضوع اجرت المثل و نحله را در یک بررسی حقوقی بشناسیم و مورد ارزیابی قرار دهیم، در حقیقت سعی شده تا به طور خلاصه به بررسی ابعاد مفهوم اجرت المثل و تفاوت آن با مفهوم نحله پرداخته شود. حال در ابتدای بحث باید به این سوال پاسخ داد که اجرت المثل چیست؟
از جمله حقوق مالی که در فقه و حقوق ایران برای زوجه بـه رسـمیت شـناخته شـده، اجرت المثل کارهای زوجه است، مطابق قانون ، زوجـه در هـر زمـانی اسـتحقاق دریافـت اجرت المثل کارهایی را که خارج از وظایف شرعیش و به دستور زوج انجـام داده اسـت دارد؛ در حقیقت اجرت المثل یکی از این حقوق ویژه ایست در که شرع و قانون برای زنان در نظر گرفته شده است یعنی اگر زن در طول زندگی مشترک و در خانه همسر خود، کاری انجام دهد که موظف به انجام آن نیست، مستحق پاداشی است که به آن اجرتالمثل گفته میشود.
البته دریافت این وجه مشروط بر این است که این امور را با قصد تبرع انجام نداده باشد و عرف نیـز بـرای آنهـا اجرت در نظر گرفته باشد. در این راستا باید به خاطر داشت که دستور زوج و قصد تبرع باید در دادگـاه احـراز شـود.
به طور کلی اجرت المثل در صورت جمع شدن شرایط ذیل در رابطه با استیفای از عمـل غیر ثابت می شود :
– وجود امر به انجام دادن عمل (که طبق نظر بعضی از حقوقدانان مراد از امر خواست است)
– نبود عقد
– عدم قصد تبرع از سوی عامل
– عرفاً یا در نزد اهل خبره برای عمل انجام گرفته اجرتی وجود داشته باشد یا عامل عادتاً مهیای آن عمل باشد
برای پاسخ به این پرسش که اجرت المثل چگونه محاسبه می شود نیز باید بیان داشت شـرایط خاصـی برای میزان دقیق اجرت المثل وجود ندارد ، بلکه اجرت المثل همچون سایر دیون اسـت و ماننـد آنهـا بـه وسـیله ی دادگاه مورد محاسبه قرار خواهد گرفت ، مگر اینکه شرط خاصی میان زوجین ضمن عقد لازمی مقرر شده باشد که در اینصورت طبق همان شرط، اجرت المثل محاسبه خواهد شد یا اینکـه زوجین در رابطه با اجرت المثل و میزان آن با یکدیگر صلح کنند.
مفهوم دیگری نیز که باید مورد شناخت و بررسی قرار گیرد مفهوم “نحله” است، نحله در لغت به معنی بخشش است و مستند شرعی آن آیه چهارم سوره نساء است . البته این حق ، تنها از منظر شرعی معتبر نبوده و قانون گذار نیز آن را معتبر می داند.
در رابطه با این سوال که نحله چیست باید بیان داشت با توجه به بند ب ماده ۶ قانون اصلاح مقررات مربوط به طلاق ، زمانی که امکان تعیین اجرت المثل برای زوجه به هر دلیلی فراهم نباشد ، با توجه به مدت زمان زندگی مشترک و کارهایی که زن در طول زندگی انجام داده است ، مبلغی به عنوان نحله برای او در نظر گرفته می شود .
میزان و مقدار نحله با توجه به استطاعت مالی شوهر تعیین خواهد شد و قاضی به صلاح دید خود و برآورد شرایط مبلغ نحله را مشخص خواهد کرد ، بنابراین نیازی به نظر کارشناس رسمی دادگستری برای تعیین مقدار نحله نیست.
این نکته را باید مد نظر قرارداد که نحله در زمان زندگی مشترک به زوجه تعلق نمی گیرد و این حق صرفا مربوط به زمانی است که مرد تقاضای طلاق داده باشد. از سوی دیگر اگر زن از انجام وظایف زناشویی کوتاهی کرده باشد و هر دلیل دیگری که از منظر دادگاه برای طلاق موجه محسوب شود ، دیگر نحله به زن تعلق نمی گیرد
باید بیان داشت که نحله و اجرت المثل در طول یکدیگر هستند و در صورتی که اجرت المثل به زن تعلق نگیرد، نحله می تواند مورد بحث قرارگیرد.
مورد بعدی که ممکن است در راستای این موضوع مورد پرسش قرار گیرد نحوه ی دعوا برای دریافت نحله و اجرت المثل است، در این راستا زوجه می تواند جدای از دادخواست صدور گواهی عدم امکان سازش که مقدمه ای بر طلاق است، دادخواست نحله و اجرت المثل را مستقل تقدیم دادگاه کند. بنابراین نیازی نیست که پس از طلاق به این امر اقدام شود. بنابراین اگر زوجه قبل از اجرای صیغه طلاق، اجرت المثل با نحله مطالبه کند، اجرای صیغه طلاق و ثبت آن در دفتر ،موکل به پرداخت حقوق زن خواهد بود .
